Acceptance Of Our Terms

This Agreement represents the Terms and Conditions for using our services and products. You are permitted to use our website solely on the basis of these Terms and Conditions. If you do not agree with them, you may not use this website. We reserve the right, at our discretion, to update and/or to revise these Terms and Conditions. Please check periodically for changes. Your continued use of the website following posting of changes to these Terms and Conditions constitute your acceptance of the said changes.

We strongly recommend that you read these Terms and Conditions carefully before submitting your order to us.

Order Acceptance, Pricing, And Cancellations

Please note that there exist cases when an order cannot be processed for various reasons. We reserve the right to refuse or cancel any order for any reason at any given time. You may be asked to provide additional verification or information, including, but not limited to, phone number and address, before we accept the order. We are determined to provide the most accurate pricing information on the website for our users. However, errors may still occur, such as cases when the price of an item is not displayed correctly on the website. In the event that an item is mispriced, we may, at our own discretion, either contact you for instructions or cancel your order and notify you of the cancellation. We shall have the right to refuse or cancel any such order whether or not the order has been confirmed through the payment option you have selected.

You may cancel your order at any time before it has been processed. Once a product is shipped, our Terms and Conditions will apply. In situations where, for instance, you have erroneously confirmed an order, our website offers an option that you may use to cancel the order provided that we have not initiated subsequent procedures to process the order. Kindly be advised that, under certain circumstances, we may refuse your cancellation. On the other hand, we may cancel your order if particular criteria of the purchase are unfulfilled: product being out-of-stock and no plans are available to restock it, pricing error, or payment refusal by the financial institution used to channel the transaction, among others.

Shipping And Handling

The shipping and handling charges displayed on our website are estimations only, and they may differ from the actual shipping charges that can only be determined once we have received the destination address and have identified weight and volume of the packaging. The total weight of the purchased items is the sum of the individual weights of the items times their corresponding quantities, and the result is portion of the total order weight.

The website offers two modes through which the packages may be delivered to the customers:

  • MITz Group Office Pickup, in which case a buyer places an order online and later visits to our physical store to collect the package. In this mode, the buyer does not incur any shipping fee provided that storage criteria, as stipulated in our Terms and Conditions, are satisfied;
  • MITz Group Savings, which is more suitable for customers outside Mwanza.

You are responsible to pay all actual shipping and handling charges. We will not accept any liability for the loss, damage, delayed delivery, or custom clearance for any prohibited items and neither will you be refunded for these types of items, and the sender of such items will be held liable. We guarantee to deliver the items in the same condition as supplied by the shipper.

Storing

We may store your purchased products, free of charge, for a period of 30 days. We may continue to store the products for a maximum of another 30 days, in which case you will incur a storage charge of TZS 5,000 per day. This fee will be payable by you at the time of requesting the shipment. Packages for which you have not given us shipping instructions by the end of 60 days will be deemed abandoned, and we may dispose them in any manner permitted by the Law.

Lost Or Damaged Shipments

In the case of loss or damage of all or part of the shipment, we will refund the item in full within 45 days from the date of issuance of the invoice.

Circumstances Beyond Our Control

We are not liable for any loss or damage arising out of circumstances beyond our control. These circumstances include, but are not limited to, natural disasters or acts of God, such as fire, earthquakes, hurricanes, tornadoes, storms, floods, fogs; plane crashes or embargoes; wars, riots, civil commotions or industrial actions; epidemics or pandemics; power cuts, communication or other utility disruptions; governmental actions or inactions; any defect or characteristics related to the nature of a shipment; and damages to or erasure of electronic or photographic images, data, or recording due to electrical or magnetic interferences.

Legal Disputes

If a dispute arises between you and MITz Group Company Limited, our goal is to provide you with a neutral and a cost-effective means of resolving the dispute quickly. Accordingly, you and the Company agree that we will resolve any claim or controversy at law or equity that arises out of this Agreement or our services as we and you otherwise agree in writing. Before resorting of these alternatives, we strongly encourage you to first contact us directly to seek a resolution. We will consider reasonable requests to resolve the disputes through alternative dispute resolution procedures, such as arbitration.

Limitation Of Liability

By using our website, you agree that we would be held free from any liability on contract, pre-contract, or other representations, in tort, including without limitation, negligence, or otherwise out of or in connection with the Terms and Conditions for any economic losses, such as, but not limited to, profile, anticipated saving, revenue, contracts or general business; loss of goodwill or reputation; and any special or indirect losses suffered or incurred by any of the parties arising out of or in connection with the provisions of any matter under these Terms and Conditions. Also, you accept that we will not be responsible or liable for any loss of content or material uploaded or transmitted through the website and accept no liability of any kind for any loss or damage from action taken or taken in reliance on material or information contained on the website. MITz Group Company Limited does not guarantee continuous, uninterrupted, or secure access to our services, and operations of our website may be interfered with by numerous factors outside of our control. Products and services of the Company are provided as is, where is, and as when available, and to the extent permissible by law, all implied warranties, conditions or other terms, whether implied by statutes or otherwise, including without limitation, any terms as to skill and care or timeliness of performance, are excluded.

Returns And Refunds

Before placing your order, we strongly advise you to read carefully and understand our policies. Where necessary, you may need to consult lawyers to further enlighten you on the policies. Our website gives you chance to peruse the policies and allows you to either accept or decline the policies before order confirmation. You are kindly advised to use this opportunity wisely. We treat return claims very seriously and with urgency. Once we receive the products from the customer, our team will carefully inspect them and identify the default party (customer or Company). And this procedure determines whether or not the customer will receive the (complete or partial) refund or replacement of the returned products. Please note that, if applicable, you may receive the refund within 45 days from the issuing date of the invoice. Products can be returned to our store provided that they have received our approval. We argue customers to inspect the conditions of the products before returning them. The Company reserves the rights to reject damaged or spoiled products. If you have any enquiry on returns, please contact our customer care through the contact details provided in our website. A return shipping fee will be charged depending upon, but not limited to, the supplier location and item weight.

Returns Of Online Purchases

In most cases, your refund will be issued through the same Credit/Debit card or mobile payment account (Tigo-Pesa, M-pesa, Airtel Money, HaloPesa, among others) that you used in the original purchase. You will be credited for the cost of the product(s); handling costs and applicable taxes are nonrefundable. Return shipping fees are nonrefundable, unless in situations where our analysis reveals that sources of errors in the returned products originated from us. Upon receipt of the products in our stores, we shall perform a thorough analysis and compare the results with the original shipment. Depending upon our observations from the analysis, we have the rights to either completely or partially refund a customer or even decline the refund. Please allow 3-5 business days for processing the returns. In either case, you will be notified on the status of your refund through your contacts registered in our system. If the screening process of the returned products show that you are eligible for the refund, then please allow 5-10 billing cycles for the refund to appear to your bank/mobile payment account.

Obligations And Product Conditions

Below are the customers’ obligations and conditions of the products purchased from us and intended to be returned to our stores:

  • Return shipping fees are incurred by a customer;
  • Items must be in their original conditions;
  • Items must be returned together with all original packing materials and accessories;
  • Electronic items must be in their original packages.
  • Electronic items must have their UPC (Universal Product Code) serial number

Coupons And Offers

Coupons/offers may not combine with any other offers/coupons. Coupons are not redeemable for cash and are redeemable for one item and one purchase only. Email notices or notices on our Facebook page (or any other communication media designated by the Company) will be the primary method by which we will communicate. We shall send notices and any other pertinent information to you through your current e-mail address registered in our website. You can send notices or other communications to us through e-mails, phones, or links provided in the “Contact Us” page of our website.

Changes to This Terms and Conditions

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. These changes are effective immediately after they are posted on this page.
